Privacy Policy

1. Introduction

In this Privacy Policy "we", "us", "our", “Club” and "Gold Coast Titans" means Titans Rugby League Pty Ltd, its associates, related entities and subsidiaries. Please read this Privacy Policy carefully as it describes how we collect, use and handle your Personal Information.

Gold Coast Titans recognises the importance of your privacy and your right to control your Personal Information and is committed to complying with applicable privacy laws (including the Privacy Act and GDPR). We will only request Personal Information that is reasonably necessary for us to perform our functions and activities as a Rugby League club or for a related secondary purpose. Please be aware, you are under no obligation to provide us with your Personal Information, but if you choose not to provide your Personal Information, you may not be able to take advantage of one or more of the features we offer.

On request and wherever it is lawful and practicable, we will offer you the opportunity of not identifying yourself, or of using a pseudonym, when entering transactions, or otherwise dealing with, Gold Coast Titans.

2. How we share your information as part of the Rugby League Exchange

Gold Coast Titans is always seeking to better understand our player and fan preferences including by analysing your Personal Information to understand trends and interests. Gold Coast Titans has, in conjunction with the National Rugby League (NRL), other clubs, Queensland Rugby League (QRL), New South Wales Rugby League (NSWRL) and selected third parties, established a data storage architecture and data sharing platform for processing Personal Information with this aim (Rugby League Exchange).

The NRL will be responsible for the maintenance and administration of the Rugby League Exchange. Gold Coast Titans will share your Personal Information with the NRL as part of the Rugby League Exchange in order to facilitate analysis of fan behaviour and preferences to improve fan support, fan offerings, provide more targeted content and products and any other purposes described in the NRL's Privacy Policy. We encourage you to read the NRL's Privacy Policy to understand how your Personal Information will be handled in relation to the Rugby League Exchange. 3. What types of personal information may we collect?

The types of Personal Information Gold Coast Titans may collect depends on the purposes for which such information is collected but may include (without limitation):

(a) your name, gender, date or birth, occupation, residential address, email address, telephone number and other contact details;

(b) memberships, corporate hospitality, subscriptions and attendance history at Gold Coast Titans matches (whether you have used your membership to purchase tickets, or as a casual ticket purchaser – including corporate hospitality or have been issued ‘complimentary’ tickets);

(c) purchasing preferences and financial details which we collect when you buy tickets, purchase merchandise and/or as part of competitions and promotions.

Gold Coast Titans will generally not collect sensitive Information from you. However, where Gold Coast Titans seeks to collect Sensitive Information from you, it will do so in accordance with applicable privacy laws (including the Privacy Act and GDPR), for example by obtaining your express consent for such a collection or where such collection is authorised by law or specifically permitted under the NRL Rules.

In addition to Personal Information, we use cookies, web beacons and other technologies on our network to collect information about your usage (for instance, third party websites you visit to better understand your preferences and what types of products and services you may be interested in).

4. How do we collect or receive your personal information?

Where it is reasonable and practicable to do so, Gold Coast Titans will collect Personal Information directly from you (without limitation):

(a) when you order merchandise through our online store located at https://shop.titans.com.au/;

(b) from the NRL, QRL, NSWRL and selected third parties (for instance, Ticketek and Ticketmaster);

(c) when you register for events/programs (both club and community based), promotions,  competitions or any other club related activities;

(d) when you complete and return feedback forms to us.

As an event promoter, and subject to strict conditions, the Gold Coast Titans also receive personal information from individuals who ‘opt in’ when purchasing tickets through Ticketmaster, who are the contracted ticketing agent of Cbus Super Stadium.

The Gold Coast Titans also receives personal information from the NRL as part of Rugby League Exchange.

The Gold Coast Titans also receives personal information from other third parties where we are required to deliver a benefit. Examples of this include but are not limited to:

(a) to issue tickets to Gold Coast Titans home matches;

(b) to issue club memorabilia or make other donations;

(c) to facilitate player, club staff and other community appearances; and

(d) to perform a function on behalf (but not limited to) of a club partner or sponsor.

5. Why do we collect, use, hold and disclose your personal information?

Gold Coast Titans collects, uses, discloses or holds Personal Information that is reasonably necessary for Gold Coast Titans to perform one or more functions or activities as a club (the primary purpose) including (without limitation):

(a) organisation, conduct and promotion of matches involving Gold Coast Titans (for instance, providing you information about upcoming ticket offers and deals for the next home matches);

(b) promotion and sale of Gold Coast Titans merchandise;

(c) direct marketing of Gold Coast Titans products or services;

(d) to establish and maintain your membership of the Club, including providing you with newsletters, magazines, renewal notices and other information necessary to inform you of the Club’s activities;

(e) where appropriate, to establish and maintain a sponsorship relationship between you and the Club and to facilitate effective communication channels;

(f) to provide the products, services or information you have requested from the Club;

(g) to answer your inquiries;

(h) to register you for events, promotions or competitions;

(i) in accordance with the membership and partnership charters of the Club;

(j) to assist us to make the Club's facilities, services and products more valuable to our members and stakeholders; and

(k) for direct marketing of products or services and to keep you informed of new developments we believe may be of interest to you.

We use, disclose or hold your Personal Information for the primary purpose for which it was collected, a related secondary purpose, or as otherwise required in accordance with applicable privacy laws (including the Privacy Act and GDPR) (for instance, we may be required to disclose your Personal Information to a law enforcement agency).

6. Who do we disclose your personal information to?

6.1 Gold Coast Titans may provide your Personal Information to third parties as part of our functions and activities including (without limitation):

(a) Delivery, courier and postal organisations: we may disclose your Personal Information to delivery, courier and postal organisations in order to deliver merchandise, memberships, hospitality or other event ticketing you order;

(b) Stadiums Queensland, The Club at Parkwood Village, Marketing Decisions Pty Ltd, ServeRite Pty Ltd (a KORE Software Company), Ignite Solutions Pty Ltd, McDonalds Australia, other venue authorities that host Gold Coast Titans home NRL regular season matches, National Rugby League, other clubs, Queensland Rugby League, New South Wales Rugby League and selected third parties (for instance, Ticketek and Ticketmaster). We may disclose your Personal Information as part of the Rugby League Exchange. The NRL and selected third parties may send you information about products and services the NRL believes will be of interest to you. If you do not wish to receive information from the NRL or selected third parties, please opt out from such promotional and marketing information as part of the relevant organisation’s preference centre or contact the NRL's Privacy Officer in accordance with the NRL Privacy Policy located at https://www.nrl.com/privacy-policy;

(d) Law enforcement and emergency services agencies: we may disclose your Personal Information where required or authorised to do so by law, including in emergency situations and to assist law enforcement agencies with active investigations. We will always ensure that those to whom we disclose your Personal Information have the legal right to receive it.

(e) Email marketing providers, market research companies, promotions management and other data analytics companies to perform direct marketing on our behalf. You will always have the right to opt out of receiving promotional materials from us.

6.2 By providing your personal information you consent to the Club’s confidential disclosure to related parties for this purpose. You may decline any marketing communications by advising the Club of your wishes by the means outlined below:

(a) to third parties where we have established partnership relationships and we believe that those organisations will provide valuable products and services to you. Such third parties will be required to keep your information confidential and to use it only to communicate the products and services to you. You may decline any third party communications by advising the Club of your wishes by the means outlined below; and

(b) to different parts of the Club to improve our customer service in general.

7. Access, correction and deletion

7.1 The Gold Coast Titans will provide you with a variety of ways to access, review and manage your Personal Information. For example, if you have an myTitans account you can use your login credentials to access, review and manage your Personal Information at any time. If you don't have an myTitans account, you can still opt out of and otherwise manage your communications preferences via links in emails and other communications we send to you from time to time. You will be responsible for ensuring your Personal Information remains accurate, complete and up to date.

7.2 Upon your request, Gold Coast Titans will take reasonable steps to let you know, in general terms, what sort of Personal Information it holds, for what purposes, and how it collects, holds, uses and discloses that information. Where Gold Coast Titans have collected your Personal Information from your directly or with your consent, you have a right to receive (upon request) that Personal Information from the Gold Coast Titans in a structured, commonly used, machine readable format and/or a right to instruct the Gold Coast Titans to transmit that Personal Information to a third party (if technically feasible).

7.3 Before supplying any Personal Information to you or updating your Personal Information at your request, the Gold Coast Titans must be reasonably satisfied as to your identity (for example, by asking to see your passport or driver's licence). The Gold Coast Titans are not under any obligation to provide Personal Information to you where the Gold Coast Titans are not required to do so under applicable privacy laws (including the Privacy Act and GDPR).

7.4 If the Gold Coast Titans refuse to provide you with access to Personal information it holds on you in the manner requested by you, the Gold Coast Titans will either:

(a) take such steps (if any) as are reasonable in the circumstances to give access to the information in a way that meets the needs of the Gold Coast Titans and you; or

(b) provide you with a written notice that sets out:

(i) the reasons for the refusal except to the extent that, having regard to the grounds for the refusal, it would be unreasonable to do so; and

(ii) the mechanisms available to complain about the refusal.

7.5 If:

(a) the Gold Coast Titans are satisfied that, having regard to a purpose for which the Personal Information is held, the information is inaccurate, out-of-date, incomplete or irrelevant or misleading; or

(b) you request the Gold Coast Titans to correct your Personal Information,

the Gold Coast Titans will take reasonable steps to correct the Personal Information to ensure that, having regard to the purpose for which it is held, it is accurate, up-to-date, complete, relevant and not misleading. The Gold Coast Titans will not charge you for making such a request or for correcting the information.

7.6 If the Gold Coast Titans refuse to correct the Personal Information at your request, the Gold Coast Titans will provide you with a written notice that sets out the same matters listed in clause 7.4(b).

7.7. You can request deletion of your Personal Information by contacting our Privacy Officer at privacyofficer@titans.com.au. In most cases we will comply with your requests unless we are required to maintain your Personal Information for legal or any other applicable reason. If the Gold Coast Titans refuses to delete the Personal Information at your request, the Gold Coast Titans will provide you with a written notice that sets out the same matters listed in clause 7.4(b).

8. Data quality and security

8.1 The Gold Coast Titans will take reasonable steps to:

(a) make sure that the Personal Information it collects, uses or discloses is accurate, complete and up-to-date; and

(b) protect the Personal Information it holds about you or that is within its direct control from misuse, interference and loss and from unauthorised access, modification or disclosure.

8.2 The Gold Coast Titans will take reasonable steps to destroy or permanently de-identify Personal Information if it is no longer needed for any purpose for which the information may be used or disclosed (at your request or otherwise) or if you withdraw your consent, unless the Gold Coast Titans are required by or under law, or a Court order, to retain such information. Where the Gold Coast Titans are required to destroy or permanently de-identify your Personal Information, it will take reasonable steps to inform other parties using, holding or disclosing the same Personal Information (including any links to, copies of or replication of that Personal Information).

9. Transborder data flows

(a) Subject to clauses 9(b) and 9(c), the Gold Coast Titans will not transfer your Personal Information to an overseas recipient unless it has first taken steps reasonable in the circumstances to ensure that the Personal Information that it transfers will not be held, used or disclosed by the recipient of the information inconsistently with, or otherwise in breach of, applicable privacy laws (including the Privacy Act and GDPR). For example, the Gold Coast Titans may adopt appropriate contractual clauses with overseas recipients that ensure their compliance with applicable privacy laws (including the Privacy Act and GDPR).

(b) We may disclose your Personal Information to overseas recipients for things such as processing membership and hosting services, most likely in China, the United States and New Zealand, although countries where such recipients are located may vary.

(c) The Gold Coast Titans may transfer Personal Information about you to someone who is in a foreign country if:
i. the Gold Coast Titans reasonably believes that the recipient is subject to a law or binding scheme that has the effect of protecting the information in a way that is, overall, substantially similar to applicable privacy laws (including the Privacy Act and GDPR) and there are mechanisms available to you to enforce that protection or scheme; and
ii. you expressly consent to the transfer after the Gold Coast Titans has informed you that the applicable privacy laws (including the Privacy Act and GDPR) will no longer apply if you provide your express consent.

10. How is your personal information secured?

We understand you have entrusted us with the protection of your Personal Information. As such, we take reasonable steps, with the assistance of the NRL, to protect your Personal Information from misuse, loss, unauthorised access, modification or disclosure. This includes engaging reputable third party service providers and ensuring that we engage (where possible and practical to do so) in best practice security systems and procedures.

11. Access to and correction of personal information

You can access or correct your Personal Information through:

(a)    your NRL Account profile; or

(b)    contacting our Privacy Officer at the 'Inquiries Procedure' set out below;

(c)     your myTitans account.

Please ensure that any written request for access or correction addressed to our Privacy Officer provides adequate detail that identifies what Personal Information you want access to or corrected. Where your request will incur costs, we may charge you a fee to cover those costs (for instance, reasonable staff costs in searching for, locating and retrieving the requested Personal Information). We will inform you of any such charges prior to your request being actioned.

In certain circumstances, we may refuse to provide you access to your Personal Information. Where we refuse you access, we will provide you with a written explanation as to the reasons for the rejection (for instance, we may refuse to disclose Personal Information to you where such access would have an unreasonable impact on the privacy of other individuals).

12. Notifiable data breaches scheme

In the event of any loss, or unauthorised access or disclosure of your Personal Information that is likely to result in serious harm to you, the Gold Coast Titans, with the assistance of the NRL, will investigate and notify you and where applicable the relevant supervisory authority (e.g. the Australian Information Commissioner) within 72 hours of becoming aware of the loss, or unauthorised access or disclosure, in accordance with applicable privacy laws (including the Privacy Act and GDPR).

13. Inquires procedure

All complaints and inquiries concerning your Personal Information, including in respect of alleged breaches of this Privacy Policy or the Privacy Act, should be directed to the Gold Coast Titans Privacy Officer:

14. Privacy Policy updates

We may update this Privacy Policy from time to time. We will post the updated version of the Privacy Policy on our website but may not personally notify you. Please check periodically to see if our Privacy Policy has been updated.

Capitalised terms in this Collection Statement have the meaning given to such terms in the Gold Coast Titans Privacy Policy or the Privacy Act.
